Please read carefully the following provisions of this Terms of Use. This is a legal agreement between you and Amigas (“Amigas”, “us”, “we”, "Service" or “our”).

By downloading Amigas and/or using any of the services enabled by Amigas (the "Services"), you acknowledge that you have read, understood, and agree to be bound by the following terms and conditions (including any additional guidelines and future modifications) and by Amigas's privacy policy. If at any time you do not agree to these terms and conditions of use, you may not use the software or services and must immediately terminate your use of the software and all services.

Summary

You should read Terms in full because they apply every time you visit Amigas, and is the terms of service that governs the relationship between the users who interact with Amigas, as well as Amigas brands, products and services, which We call the "Amigas Services" or "Services". By using or accessing the Amigas Services, you agree to this Terms.However, just in case you ever need a reminder of the main points, here's a quick basic Terms:

• You will not use Amigas Services if you are under 18.
• We're not responsible for any materials that you send or address while you are using Amigas and We don't monitor the contents in your personal devices, but if We find or someone alerts about your inappropriate activities, We will, in our sole discretions, remove such materials.
• You will not use Amigas to do anything unlawful, misleading, malicious, or discriminatory.
• Amigas is devoted to creating harmony and a comfortable environment to make friends. If the system detects your violation of the Terms, Amigas will adopt a corresponding measure.

1. Privacy

2. Community Guidelines and Surveillance Strategies

You are able to send all kinds of things to other users on Amigas, including photographs, messages and other content ("Content"). You own all of the content and information you send on Amigas. While there are some rules about what is acceptable though, so when you are using Amigas you may not send any Content which:

• contains the information, comment or any other forms of content about a person who is under 18 years old;
• contains expletives or language which could be deemed offensive or is likely to harass, upset, embarrass, alarm or annoy any other person;
• is obscene, pornographic or otherwise may offend human dignity;
• is abusive, insulting or threatening, or which promotes or encourages racism, sexism, hatred or bigotry;
• encourages any illegal activity including, without limitation, terrorism, inciting racial hatred or the submission of which in itself constitutes committing a criminal offence;
• is defamatory;
• involves the transmission of "junk" mail or "spam";
• contains any spy ware, viruses, corrupt files, worm programmes or other malicious code designed to interrupt, damage or limit the functionality of or disrupt any software, hardware, telecommunication, networks, servers or other equipment, Trojan horse or any other material designed to damage, interfere with, wrongly intercept or expropriate any data or personal information whether from Amigas or otherwise;
• itself, or the sending of which, infringes any third party's rights (including, without limitation, intellectual property rights and privacy rights);
• shows another person which was created or distributed without that person's consent.
• If any of the above occurs, Amigas has the right to suspend, terminate or restrict provision of the Services under this Agreement at any time and is not obligated to bear any liability to you or any third party.

3. Protecting Other People's Rights

• You will not send content or take any action on Amigas that infringes or violates someone else's rights or otherwise violates the law.
• We can remove any content or information you send via Amigas if we believe that it violates this Terms or our policies.
• If we remove your content for infringing someone else's copyright, and you believe it was removed by mistake, we will provide you with an opportunity to appeal.
• If you repeatedly infringe other people's rights, we will disable your account when appropriate.
• You will not use our copyrights or Trademarks or any confusingly similar marks without our prior written permission.
• If you collect information from users, you will obtain their consent, make it clear you (and not Amigas) are the one collecting their information, and send a privacy policy explaining what information you collect and how you will use it.
• You will not send anyone's identification documents or sensitive financial information on Amigas.
• You will not tag users or send email invitations to non-users without their consent.

4. Prohibition of CSAE (Child Sexual Abuse Exploitation) Content

We are deeply committed to fostering a safe, respectful, and inclusive environment for all users of our platform. To uphold this standard, we strictly oppose and prohibit any form of CSAE (Child Sexual Abuse Exploitation) behavior, as well as any activities that involve stalking, abusive language, or other forms of harm directed at individuals. CSAE behavior undermines the core values of our community and can have serious emotional, psychological, and physical consequences for those affected. As such, we do not tolerate any actions that cause emotional distress, physical harm, or reputational damage to any users, whether intentional or otherwise.

This policy encompasses a wide range of harmful behaviors, including but not limited to threats, harassment, intimidation, and cyberbullying, as well as any content or actions that seek to manipulate, exploit, or abuse others in any form. We take these violations very seriously, as they can have lasting effects on victims and the broader community.

In the event that we discover any CSAE-related content, we will immediately remove it from our platform to prevent further harm. This action will be taken without delay to ensure the safety of our community. Our platform employs a combination of automated systems and manual review processes to detect such content, but we also rely on the vigilance of our users to report any inappropriate or harmful material.

For cases involving severe violations or repeated offenses, we reserve the right to terminate your account without prior notice. This action is necessary to protect the safety and well-being of other users and to maintain the integrity of our platform. Any user found engaging in CSAE behavior or other forms of abuse may face not only account termination but also potential legal consequences. We cooperate fully with law enforcement agencies and regulatory bodies to investigate and take appropriate action against those who engage in illegal activities. If necessary, we will provide authorities with relevant data and assist in the legal proceedings to ensure accountability.

By using our platform, you acknowledge and agree to abide by these rules, helping us create a safe space where all users can engage in positive, respectful, and responsible ways. We are committed to holding violators accountable and taking proactive steps to safeguard our community from harm.

5.Termination

• Suspend your use of (where applicable) and your right to access and/or use Amigas or submit any Content to Amigas;
• Make use of any operational, technological, legal, or other means available to enforce the Terms (including without limitation blocking specific IP addresses);
• We will try (but we are not obliged) to notify you if your access to Amigas and/or your Profile is to be or has been suspended or terminated;

6. Proprietary Rights in Content on Amigas

• Amigas does NOT claim ANY ownership rights in the text, files, images, photos, video, sounds,musical works, works of authorship, applications.or any other materials (collectively, "Content") that you send on or through the Amigas Services. By displaying or publishing ("sending") any Content on or through the Amigas Services, you hereby grant to Amigas a non-exclusive, fully paid and royalty free, worldwide, limited license to use, modify,delete from, add to, publicly perform, publicly display, reproduce and translate such Content,including without limitation distributing part or all of the Site in any media formats through any media channels, except Content not shared publicly("private") will not be distributed outside the Amigas Services.
• You represent and warrant that: (i) you own the Content sent by you on or through the Amigas Services or otherwise have the right to grant the license set forth in this section, (ii) the sending and use of your Content on or through the Amigas Services does not violate the privacy rights, publicity rights, copyrights, contract rights, intellectual property rights or any other rights of any person, and (iii) the sending of your Content on the Site does not result in a breach of contract between you and a third party. You agree to pay for all royalties, fees, and any other monies owing any person by reason of Content you send on or through the Amigas Services.
• The Amigas Services contain Content of Amigas("Amigas Content"). Amigas Content is protected by copyright, trademark, patent, trade secret and other laws, and Amigas owns and retains all rights in the Amigas Content and the Amigas Services. Amigas hereby grants you a limited,revocable,nonsublicensable license to reproduce and display the Amigas Content(excluding any software code) solely for your personal use in connection with viewing the Site and using the Amigas Services.
• The Amigas Services contain Content of Users and other Amigas licensors.Except as provided within this Agreement, you may not copy, modify,translate, publish, broadcast, transmit, distribute,perform, display, or sell any Content appearing on or through the Amigas Services.
• Amigas performs technical functions necessary to offer the Amigas Services, including but not limited to transcoding and/or reformatting Content to allow its use throughout the Amigas Services.

7. Disclaimers

• You shall be fully responsible for any risks involved in using Amigas Services. Any use or reliance on Amigas Services will be at your own risk.
• Under no circumstance does Amigas guarantee that the Services will satisfy your requirements, or guarantee that the Services will be uninterrupted. The timeliness, security and accuracy of the Services are also not guaranteed. You acknowledge and agree that the Services is provided by Amigas on an “as is” basis. Amigas make no representations or warranties of any kind express or implied as to the operation and the providing of such Services or any part thereof. Amigas shall not be liable in any way for the quality, timeliness, accuracy or completeness of the Services and shall not be responsible for any consequences which may arise from your use of such Services.
• Amigas does not guarantee the accuracy and integrity of any external links that may be accessible by using the Services and/or any external links that have been placed for the convenience of you. Amigas shall not be responsible for the content of any linked site or any link contained in a linked site, and Amigas shall not be held responsible or liable, directly or indirectly, for any loss or damage in connection with the use of the Services by you. Moreover, Amigas shall not bear any responsibility for the content of any web page that you are directed via an external link that is not under the control of Amigas .
• Amigas shall not bear any liability for the interruption of or other inadequacies in the Services caused by circumstances of force majeure, or that are otherwise beyond the control of Amigas . However, as far as possible, Amigas shall reasonably attempt to minimize the resulting losses of and impact upon you.

8. Indemnity

You agree to defend, indemnify and hold harmless Amigas, its officers directors, employees and agents, from and against any and all claims, damages, obligations, losses liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:(i) your use of and access to the Amigas Service;(ii) your violation of any term of these Terms; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of your User Status Submissions caused damage to a third party. This defense and indemnification obligation will survive this Terms and your use of the Amigas Service. to a third party.

9. Payment for Paid Services

Amigas may include the virtual gifts, coins (“Props”) which can be bought by the users when using Amigas. Users will use real money to buy Amigas Props in accordance with the rules, policies and processes of Amigas Props system, and then use Props to use part of Amigas's functions or send to other Users.

Before users start using the Props, Amigas will give the user clear instructions, and should after users confirm their willingness to pay and use the Props, Amigas will proceed payment proceeds of user buying the Props through the Pay Facility in accordance with the rules, policies and processes set forth. If then you refuse or choose not to follow the instruction of payments, it shall be deemed that you do not confirm your willingness of paying and use of the Props and you will not able to use such Props.
• You agree and accept that Amigas is neither acting as trustee nor acting in a fiduciary capacity with respect to the Props Services in consideration of providing the third party Pay Facility for facilitation of your subscription of the Props.
• Refund Policy. Unless otherwise required by the applicable law, no refund will be entertained after the Props has been purchased.

10. Amendments

We reserve the right to make changes to these terms and give you the opportunity to review and comment on the revised terms before continuing to use our Services. We may provide notice on the Website if we make changes to policies, guidelines or other terms referenced in or incorporated by this Statement.
